End User License Agreement

This EULA governs your use of MURMUR software, the plugin and standalone builds of Phosphor, Undertow, Splay, Fathom, Baxstrom, and any other product in the family distributed under this agreement, distinct from the Terms of Service governing the murmurmusic.ai website and account services.

1. License Grant

Subject to your compliance with this agreement and any applicable subscription or purchase terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use MURMUR software on devices you own or control, for music production and sound design purposes. A Creator (one-time) purchase licenses that specific instrument permanently; an All Access subscription licenses every instrument in the family for as long as the subscription is active.

2. Open Source & Third-Party Components

MURMUR is built using the JUCE framework and other third-party libraries, each distributed under its own license terms (see the project’s published third-party license notices for full text and attribution). This EULA governs the MURMUR application as a whole; it does not restrict your rights under any applicable open-source license for included components.

3. Restrictions

You may not redistribute, sublicense, rent, lease, or sell the software itself, or circumvent its license-activation mechanism. You may freely distribute audio and patches you create using the software, including for commercial purposes, subject to the Terms of Service’s community-content section where applicable.

4. Licensing & Your Devices

Your licence belongs to your MURMUR account and is not transferable except as permitted by your subscription or purchase terms. You license the software by signing in to Tidepool on a computer you own or control; Tidepool then licenses the plugins on that computer for your account, and each plugin checks in with us periodically to confirm the licence is still valid. You can remove a computer from your account at any time, which ends the licence on it. We may suspend or revoke a licence associated with fraudulent activity, a violation of these terms, or a chargeback on the associated payment.

5. AI-Generated Content

Some MURMUR products include features that use AI to generate a patch, preset, or suggestion from a prompt, photo, or audio analysis you provide. Generated output can be unexpected or unsuitable; you are responsible for reviewing it before use, and normal ownership rules for content you create with the software (Section 3, and the Terms of Service) apply equally to AI-assisted results.

6. Updates

We may release updates to the software from time to time, including changes to functionality described in release notes. Continued use of the software after an update constitutes acceptance of that update.

7. Disclaimer & Limitation of Liability

The software is provided “as is,” without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the software, including loss of audio projects or data. 8. Termination

This license terminates automatically if you violate its terms. Upon termination, you must stop using the software and, if requested, confirm its removal from your devices. Termination of this license does not by itself entitle you to a refund; see the Refund Policy.

9. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, and represent that you are not located in, or a resident or national of, any country subject to a comprehensive U.S. embargo, and are not on any U.S. government restricted-party list.
