Terms of Service

1. Acceptance of Terms

These Terms of Service govern your access to and use of murmurmusic.ai and your MURMUR account. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service. Your use of any MURMUR desktop plugin or standalone application (Phosphor, Undertow, Splay, Fathom, Baxstrom, and others) is separately governed by our End User License Agreement.

2. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account, and old enough to enter a binding contract in your jurisdiction to make a purchase. You are responsible for keeping your account sign-in secure, including the Tidepool sign-in that licenses plugins on your computers, and for all activity that occurs under it. You must provide accurate information when creating an account and keep it up to date.

3. Plans, Purchases & Billing

MURMUR offers several ways to pay for the service, and this section applies to all of them:

  • All Access subscription: billed on a recurring basis (monthly or annual, as selected at signup) until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Creator purchases: a one-time payment that permanently unlocks a single instrument. Creator purchases do not expire and are not affected by any later subscription cancellation.
  • Koins: a prepaid credit balance spent on AI-generation features inside the plugins. Koins granted with a free account, a subscription, or a purchase have no cash value, cannot be redeemed for cash, transferred between accounts, or exchanged, and may expire if your account is closed.

See our Refund Policy for details on refunds and cancellations. Prices are subject to change on notice; changes will not affect a billing period you have already paid for.

4. Cancellation & Auto-Renewal

The All Access subscription automatically renews at the end of each billing period, monthly or annual, whichever you selected, at the then-current price, until you cancel. We will not charge you for a renewal if you cancel before the renewal date.

How to cancel. Cancel any time from your account’s subscription management page, which opens our payment processor’s secure billing portal, or by emailing admin@murmurmusic.ai from the email address on your account. Cancellation takes effect at the end of your current billing period, not immediately.

What happens when you cancel. You keep full All Access, every instrument, your AI-generation allowance, and the community library, through the end of the billing period you already paid for. After that, your account reverts to the Free tier: access tied specifically to the subscription (for example, Undertow, Splay, Fathom, and Baxstrom, if you did not separately buy them) ends, but this does not delete your account, your Koin balance, or any patches, packs, or Creator purchases you own, those are unaffected by a subscription ending.

Creator purchases and Koins are one-time payments, not subscriptions, so there is nothing to cancel for them. All payments, the subscription, Creator purchases, and Koins alike, are final and non-refundable except as described in the Refund Policy. You may resubscribe to All Access at any time; doing so starts a new billing cycle at the price in effect when you resubscribe.

5. Acceptable Use

You agree not to:

  • Circumvent usage limits, license activation controls, or Koin metering;
  • Reverse engineer the software beyond what applicable law expressly permits;
  • Use the service to generate, publish, or distribute unlawful, infringing, or abusive content;
  • Interfere with or disrupt the service, or attempt to access accounts or data that are not yours;
  • Use automated means to access the service outside of a documented, authorized API or integration.

6. Content You Create & the Community Library

You retain ownership of the patches, packs, and other content you create using MURMUR, including content generated with the help of an AI feature. By publishing a patch, pack, or other content to the community library, you grant other users a license to download and use it, and you grant us a license to host, display, and distribute it as part of the service, under the community sharing terms displayed at publish time. You are solely responsible for content you publish and confirm you have the rights to share it.

Copyright complaints. If you believe content on the service infringes your copyright, send a notice to admin@murmurmusic.ai identifying the work and the material you believe infringes it. [Designate a formal DMCA agent and register it with the U.S. Copyright Office before publishing, if the business serves U.S. users and wants DMCA safe-harbor protection.] We may remove content and terminate the accounts of repeat infringers.

7. Third-Party AI Features

Some features (the AI Patch Agent, photo-to-reverb, cloud mastering) send a prompt, photo, or audio-analysis summary you provide to a third-party AI model to generate a result. AI-generated output can be wrong, unexpected, or unsuitable for your use, you are responsible for reviewing and deciding whether to use it, the same as any other tool in your workflow.

8. Termination

We may suspend or terminate accounts that violate these terms, engage in fraud, or abuse the service. You may stop using the service and request account deletion at any time by contacting us. Sections of these terms that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will continue to apply.

9. Disclaimer & Limitation of Liability

The service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, MURMUR is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the service. 10. Governing Law & Disputes
